Plastic surgery malpractice is a preventable deviation from the accepted standard of care that causes serious harm, not simply a cosmetic result a patient dislikes. Our Texas plastic surgery malpractice lawyers represent patients and families across the state in medical spa and plastic surgery cases involving death or catastrophic, permanent injury caused by negligence.

Botched Surgery vs Medical Malpractice Cases: What Our Law Office Handles
When a cosmetic procedure doesn’t meet a patient’s expectations, this doesn’t always mean the plastic surgeon or facility can be held liable for medical malpractice. You can only sue for medical malpractice when a healthcare provider has a duty to provide adequate care expected of their profession, fails to meet that standard, and you suffered measurable damages as a result.
Understanding whether or not you can seek justice and compensation for your situation is critical. The following factors can help clients answer whether or not they were victims of cosmetic surgery malpractice in Texas.
The following are NOT considered medical malpractice in cosmetic surgery:
- Botched surgery: a result the patient doesn't like despite competent care. Examples can include BBL or breast implant asymmetry, severe scarring, dissatisfaction with appearance, or a procedure that heals differently than expected.
- You provided informed consent to a complication the cosmetic surgeon explained
- Needing additional surgery to improve an aesthetic result
The following ARE considered cosmetic surgery malpractice:
- Patient death after a cosmetic procedure
- Brain injury, paralysis, or permanent nerve injury
- Organ perforation, sepsis, or uncontrolled bleeding
- Life-altering harm that should have never happened
- Catastrophic disfigurement caused by negligence, not by a disclosed risk
The Difference: Being embarrassed by a result doesn’t qualify. Informed consent to an accepted risk is not a medical mistake. Plaintiffs must prove that a competent cosmetic surgeon, anesthesia provider, nurse, or other medical professional would have acted differently under similar circumstances; the preventable failure to meet the Texas standard of care caused the injury, which resulted in measurable harm.
High-Risk Procedures & Cosmetic Surgery Errors in Texas
Most potential claims are caused by the same forms of negligence. Complication rates for safe plastic surgery procedures increase when performed in high-volume or unaccredited surgical centers. Our cosmetic surgery malpractice lawyers handle the following lawsuits for surgical errors in Texas and more:
Gluteal Fat Grafting/Brazilian Butt Lift (BBL) Injury
The Brazilian butt lift, or BBL, malpractice cases have some of the clearest examples of negligence. If a plastic surgeon accidentally injects fat into a vein, this can cause a fatal embolism. This is malpractice, not an inherent risk. Non-fatal complication rates increase from 7% to 9.9% in hospitals and regulated surgical centers to 37.9% in high-volume clinics. BBL lawsuits typically include:
- Symptomatic hypovolemia and fluid shock in 35.1% of high-volume cases, when aggressive multi-zone liposuction pulls out too much fluid and blood and blood pressure crashes
- Severe post-surgical anemia in up to 72.9% of patients in aggressive fat-harvesting environments, often requiring iron transfusions or hospital monitoring
- Systemic sepsis and severe infection up to 18.9% in low-cost regional facilities; under 1% in accredited hospitals
- Emergency hospital admission in 35.9% of documented BBL adverse events
- Unplanned return to the OR in 12.6% of injured patients, to stop internal hemorrhaging, drain deep fluid, or debride infected tissue
Liposuction Malpractice (including Large-Volume/High-Definition)
Liposuction accounts for 18.3% of all aesthetic body surgery lawsuits, trailing only abdominoplasty. Texas Medical Boards often cite cosmetic surgeons for removing too much tissue during large-volume lipo in lower-care office settings. Large-volume lipo means the plastic surgeon extracts 5,000 cc (5 liters) or more of total aspirate. Our Texas liposuction malpractice lawyers understand how crossing this threshold turns localized cosmetic procedures into systemic trauma:
- Systemic complications spike past the 5-liter threshold, with the serious adverse event rate jumping to 9.9% in high-volume facilities
- Internal organ perforation at a 1% incidence rate. This includes intestine, liver, bowel, and bile duct perforation injuries in Texas
- Severe post-operative blood loss in up to 18% of large-volume patients
- Tumescent fluid toxicity: exceeding the mg/kg safety threshold risks Local Anesthetic Systemic Toxicity (LAST)
- Device component failures, with FDA MAUDE data showing 13% of federal complaints involve ultrasound-assisted liposuction devices
"Mommy Makeover" Malpractice & Combination Surgery Malpractice Claims
Combining many procedures allows for one recovery process. The problem is that the risk of medical mistakes combines, too. Stacking cosmetic procedures extends anesthesia time and increases the risk of severe complications. The chain surgical center infection fact pattern of mommy makeover malpractice cases is clear:
- Compounding risk multiplier: bundling additional surgeries raises the major complication rate by 4.5x
- “Marathon” surgery: Cosmetic procedures beyond 5 to 6 hours cause a sharp spike in deep tissue complications
- Blood clots (DVT/PE): Tummy tucks carry a baseline 1 in 13,000 mortality rate. Combining it with breast, liposuction, or other additional surgeries raises VTE rates to 9.3%
- Severe ischemic tissue necrosis in up to 4.4% of complex cases, killing skin and tissue around the umbilical or breast incisions and leaving permanent disfigurement
- Wound breakdown (dehiscence) in 10% to 12.5% of combination patients, often exposing mesh or implants to contamination
- Undiagnosed internal hemorrhaging, hypoxia and brain damage, and hypovolemic shock from fluid shifting
67% of successful malpractice actions for mommy makeovers stem from negligent post-operative care and monitoring failures.
Tummy Tuck Malpractice Cases
Among the injuries that are considered medical malpractice, tummy tuck malpractice cases are almost never about “looks.” Abdominoplasty accounts for 11.9% of all cosmetic surgery malpractice lawsuits. 71.9% cite negligent physical technique and 62.5% allege poor treatment after the cosmetic procedure.
The baseline risk of tummy tucks is elevated: the major complication rate is 4.0%, nearly triple the 1.4% baseline of other standard cosmetic surgeries. Our tummy tuck malpractice lawyers often see the following:
- Internal bleeding (hematomas) in 44% of all major post-op complications
- Bacterial infection and sepsis in 40.6% of litigated tummy tuck complications
- Chronic seroma traps in 23.6% of standard complication cases
- Lesión nerviosa permanente in 31.3% of litigated injuries
- Venous thromboembolism (DVT/PE) is the leading cause of fatalities
Nerve Damage After Facelift
Nerve damage after a facelift happens more than many realize. Facial nerve severance leads to permanent paralysis and disfigurement, and anesthesia complications during long facial cases add a second catastrophic pathway.
- Facial nerve injury is the primary physical injury in 26.3% of all litigated facelift malpractice cases, second only to severe, permanent facial scarring.
- Out-of-scope liability climbs sharply when the facelift is performed by a physician without proper training
Breast Surgery Injury: Breast Augmentation / Reduction & Lifts
Breast procedures, such as breast augmentation, breast lift, or breast reduction, are the most common types of plastic surgery. Severe injuries from breast augmentations and other related procedures include fatal anesthesia complications, hemorrhage, and nerve injuries, along with body-contouring and spinal positioning injuries during combined cases.
- Venous thromboembolism (VTE) fatalities, especially when breast augmentation/lift is combined with other procedures
- Breast Implant-Associated Anaplastic Large Cell Lymphoma (BIA-ALCL) is linked to textured implants, when delayed seroma or capsular warning signs go unrecognized
Common Injuries Our Cosmetic Surgery Malpractice Lawyers Handle
The following are the most common injuries our Texas cosmetic surgery malpractice attorneys handle:
Common types of anesthesia error injuries in Texas include anesthetic overdose, failure to monitor vitals, and other anesthesia mistakes resulting in anoxic brain damage or fatal outcomes.
Fat forced into a vein during a Brazilian butt lift can kill a patient. The most common type of cosmetic surgery malpractice involves injection depth.
Occurs when a doctor or surgeon fails to control bleeding, fails to transfuse or return to the OR, or discharges an unstable patient.
Failure to treat or send a patient to the ER for infections can result in malpractice claims for sepsis in Texas.
Patients can suffer DVT and pulmonary embolisms when medical staff doesn't perform risk assessments, provide anticoagulant prophylaxis, or ignores warning signs.
Facial nerve severance in facelifts, spinal cord injuries from body contouring, and other forms of nerve damage and permanent paralysis claims in Texas.
Organ damage from surgeries in Texas often involves cannulas puncturing bowels, livers, or spleens, leading to peritonitis, hemorrhage, or fatalities.
IV infiltration in Texas typically occurs when an unmonitored IV line leaks into the surrounding tissue and causes necrosis or síndrome compartimental.
Medical burn injuries in Texas often include full-thickness burns and lead to permanent scarring, often from undertrained or unsupervised medical staff.
When a cosmetic procedure ends in loss of life, the claim becomes a Texas patient death by medical malpractice caso.
Our cosmetic surgery injury lawyers can help determine your legal options for seeking justice and compensation.
Texas Cosmetic Surgeons & Clinics With Disciplinary Actions and Litigation
If you suspect malpractice occurred at a heavily advertised plastic surgery chain, you’re probably not the first person injured by medical negligence. When high-volume clinics generate patterns of malpractice, our Texas cosmetic surgery injury lawyers can pursue the corporate entity for negligent hiring, credentialing, and supervision, not just the plastic surgeon.
Below are examples of medical board records, court filings, and other reports.
Sono Bello (San Antonio & Addison)
Sono Bello is a national cosmetic surgery chain with locations in San Antonio and Addison. Many patient reviews use the term, “Sono Bello nightmare.“
De acuerdo a un KFF Health News investigation, Sono Bello and its affiliated surgeons, including associate Dr. Dare Ajibade, have defended over 60 medical malpractice claims since April 2013, including at least four wrongful-death lawsuits.
DVA Plastic Surgery (Houston) - Dr. Dare Ajibade
Dr. Dare Ajibade of DVA Plastic Surgery in Houston received a Texas Medical Board remedial plan finding that he did not meet the standard of care during a liposuction procedure. According to the Miami Herald and other reports, Dr. Ajibade has also been named in medical malpractice lawsuits over surgical errors and patient complications at the surgical center, DVA Plastic Surgery.
Mia Aesthetics (Houston, Dallas & Austin)
Mia Aesthetics, a multi-state chain, has faced at least 30 medical malpractice cases, primarily between 2020 and 2025, alleging cosmetic surgery errors, disfigurement, and inadequate post-operative care, according to the Miami Herald.
The Texas Medical Board separately found that Austin plastic surgeon Dr. Rambod Charepoo failed to meet accepted standards of care and documentation for five cosmetic surgery patients.
Goals Aesthetics and Plastic Surgery / Keystone Plastic & Reconstructive Surgery (Houston Area)
Goals Aesthetics is a cosmetic surgery chain, promising a “dream body in just one visit.” A September 2025 investigation identified over 40 medical malpractice lawsuits over the past 7 years. Victims allege that Goals and affiliated plastic surgeons didn’t provide competent care, were responsible for severe scarring and wrongful death tied to Brazilian Butt Lift, liposuction, and other cosmetic procedures, according to NBC News.
Dr. Thomas Shannon, who works as a plastic surgeon at both Goals and Keystone Plastic & Reconstructive Surgery, was named a defendant in Hornes v. Shannon, Goals, a medical malpractice lawsuit over a double BBL. He’s also named in Fortune, Martina v. Thomas O. Shannon, M.D., among the Goals-related filings. The Texas Medical Board also cited Dr. Thomas Shannon for negligent record-keeping.
AirSculpt Lawsuit - Elite Body Sculpture (Dallas, Houston & Austin)
Elite Body Sculpture is a cosmetic surgery chain with Texas locations in Dallas, Houston, and Austin. It markets procedures under the AirSculpt brand. Patients have submitted reports and filed claims after AirSculpt-branded procedures.
One AirSculpt lawsuit involved a patient who died days after an AirSculpt procedure. The family sued Elite Body Sculpture and the plastic surgeon for malpractice, reaching a $2 million settlement. The victim was one of three patients who died after surgical procedures by the same plastic surgeon. Two related wrongful death lawsuits remain pending.
FacePLUS+ Plastic Surgery Institute (PSI) (Lubbock) - Dr. Thanapoom Boonipat
El Texas Medical Board entered an agreed order in June 2026 against Dr. Thanapoom Boonipat of FacePLUS+ Plastic Surgery Institute in Lubbock. The recent order cited large-volume office liposuction that needed a higher-care facility, inadequate treatment of possible anesthetic toxicity, leaving the operating room for around 2 hours mid-procedure, an inadequately supervised nurse giving sedation, and incomplete records.
Houston Galleria Surgery & Medspa - Dr. Marcos Hiroshi Ikeda
The Texas Medical Board found that Dr. Marcos Hiroshi Ikeda of Houston Galleria Surgery & Medspa failed to address post-operative complications and report, and allowed unlicensed foreign medical graduates to present themselves as physicians, according to TMB newsroom. He now practices under a required medical monitor.
Additionally, neither Dr. Ikeda nor Dr. Xydas has board certification in plastic surgery; they’re both OBGYNS performing elective procedures.
New Life Cosmetic Surgery & Wellness Center (San Antonio & McAllen) - Dr. Daniel Christian Lee
El Texas Medical Board’s March 2026 bulletin lists a formal complaint filed against McAllen plastic surgeon Daniel Christian Lee , alleging he didn’t meet the accepted standard of care, failed to practice in an acceptable professional manner, and improper supervision or delegation.
A formal complaint is a pending, unproven allegation, not a disciplinary finding, and Dr. Lee has not been found by the Board to have violated any standard.
Common Forms of Negligence Behind Cosmetic Surgery Malpractice Claims in Texas
Certain types of medical negligence appear frequently. Common types our Texas cosmetic surgery malpractice attorneys see include:
- Wrong doctor for the case: Many procedures require surgeons with specialized training. This includes craniofacial reconstruction, microsurgery, complicated revision surgery, or complex corrective procedures. Many chains staff surgeons that aren’t within this specialty. In many cases, the defendant performs complex surgical procedures without plastic surgery board certification.
- Wrong facility: Performing a procedure in an office that lacks proper equipment, emergency resources, transfer agreements, or qualified staff can delay treatment if complications arise.
- Operating beyond training or scope: Surgeons can commit medical malpractice by operating without the specialty training, experience, or credentials required to perform that specific surgical procedure. This increases the risk of surgical errors, permanent injuries, and the need for corrective procedures.
- Over-scheduling: Many medical boards have cited plastic surgeons rushing between too many procedures. This decreases the patient’s quality of care and level of attention, which increases the risk of preventable mistakes.
- Fake-Sounding Credentials & Lack of Informed Consent: Some providers exaggerate or misrepresent their training, board certifications, or experience to attract patients. The American Board of Plastic Surgery is ABMS-recognized. Many patients see “board certification” or “board-certified” on a web page and believe they’re being operated on by a board-certified plastic surgeon, when in reality, a general surgeon is the doctor operating.

Why Serious Plastic Surgery Cases Need a Firm Built for Them
We focus the way we do because Texas makes medical malpractice cases involving cosmetic surgery errors particularly difficult to bring. Victims need attorneys skilled in navigating the following hurdles:
- Noneconomic damages are capped by statute
- Plaintiffs must serve a qualified expert report within 120 days, or courts dismiss the case
- Our attorneys may need to hire an expert plastic surgeon, anesthesiologist, pathologist, and/or life-care planner
- Plastic surgery malpractice cases often cost $100,000+ to litigate. This is funded by our firm through trial.
This is why our San Antonio malpractice firm concentrates on more tragic cases involving catastrophic injuries and fatalities. Focusing our resources is the only way to fund the experts these potential claims demand and carry them through trials to verdicts.
Compensation in a Texas Plastic Surgery Malpractice Claim
Because Texas caps noneconomic damages in malpractice claims, the economic side, or measurable damages, is where most of the value lies. Our Texas plastic surgery malpractice attorneys calculate the following and more:
- Lifetime medical and attendant care, rehab, and equipment
- Reconstruction and revision surgeries
- Lost wages and loss of earning capacity
- In fatal cases, the support and inheritance the survivors lost, plus companionship and mental anguish
- Noneconomic damages, like scarring and disfigurement, permanent impairment, pain and suffering
- Exemplary or punitive damages where a clinic operated knowing it could not rescue a patient
Statute of Limitations For Catastrophic Injuries & Wrongful Death
The Texas statute of limitations for plastic surgery malpractice claims is generally two years from the date of the negligent act, date of death, or the last date of treatment. There are exceptions if the harm was later discovered and for children filing on behalf of deceased parents.
The state requires a 12-day pre-suit notice for all medical malpractice claims. It also requires a medical expert report explaining how the healthcare providers deviated from accepted practices.
These cases require attorneys with specific expertise proving lack of competent care expected from cosmetic surgeons. If you’ve been harmed by plastic surgery malpractice, contact our law office for a free case review.

Having a truck and trailer rear end me on a highway in 2024 started the toughest season of my life. After countless hours of doctor's appointment, PT, injections, two surgeries, and more, no amount of money could give me that time or season of my life back. But I appreciate that Jacy and Nyssa's hard work to recoup the costs and get money for future costs so I can move forward. I couldn't have gotten through it all without them! And I appreciate the team approach at Janicek. Beth, Phil and I'm even more that I didn't personally interact, were in it with me.![]()

We were referred to Janicek Law firm from a lawyer in Brownsville, who pointed out that they are experts in the field of medical malpractice and I am so grateful. We worked with Andrew and Gaby and they were dedicated and worked hard to get us the best possible outcome. They kept us informed and updated through every step of the process, always with a friendly and very professional disposition. Despite language and distance challenges, they accommodated all of our needs, and I would highly recommend Janicek Law Firm. They made a bad situation better by listening to our concerns, helping us through a sorrowful time for my family, and advising on how to defeat our opponent. For any families that have a beloved and elderly relative who suffered in the hands of callous and neglectful medical institutions, Janicek Law Firm were amazing in advocating for our relative and making these corporate entities accountable. Thank you, Andrew and Gaby, we really appreciated your help!![]()

I have started this review so many times, but every time I do, I realize there simply aren't enough words to thank the people at Janicek Law. Almost 3 years ago, my world ended. I lost my son, Zayden—the greatest love of my life. My other son, Zy, witnessed the unimaginable that day. He carries those memories with him every single day, and we are forever grateful that he is still here because we very easily could have lost him too. Our family didn't just experience a tragedy—we experienced trauma that changed us forever. When I first met the team at Janicek Law, I wasn't just grieving. I was broken. I was a mother trying to survive the unthinkable while helping my surviving son heal from something no child should ever witness. I didn't know if I had the strength to keep fighting. There were so many moments when I wanted to give up. Every deposition, every conversation, every piece of evidence forced me to relive the worst day of my life. I told them I couldn't do it anymore. But they never let me forget why we were fighting. They reminded me that Zayden deserved justice. They reminded me that Zy deserved justice. They believed in my family even when I couldn't believe in myself. What makes Janicek Law different is that this was never just a job to them. They never made me feel like another client or another case number. They knew my children by name. They celebrated Zayden's life. They cried with us, prayed with us, hugged us, encouraged us, and walked beside us through every heartbreaking step. They carried a piece of this burden with us, and I will never forget that. Even after the case was over, they didn't disappear. They still answer my calls. They still help me with paperwork. They still check on me. They still make me feel like my family matters. That's something you cannot fake. That's love. Somewhere along the way, I stopped seeing them as "my attorneys" and started seeing them as family. And I truly believe I have a family for life. No amount of money will ever bring my little boy back. I would trade every penny to hear his laugh one more time. But because of Janicek Law, I have peace knowing that his life mattered, his story was heard, and that they fought for my boys with everything they had. From the deepest part of a mother's heart... thank you. Thank you for loving my children. Thank you for never giving up on us when I wanted to give up myself. Thank you for standing beside us through the darkest chapter of our lives. You gave my family more than legal representation—you gave us hope, dignity, and people we will love for the rest of our lives. You helped a grieving mother find the strength to be the voice her son no longer had. In a world that can feel so unfair, you reminded me that there are still genuinely good people. We love each and every one of you, and we will never forget what you did for Zayden, for Zy, and for us.❤️
